CA to ban ICE immigration centers and prisons -18,000 prisoners

Closing immigration centers that hold 18,000 people should rank close to the top of the list in asinine decisions. Add a couple more thousand of California prisoners that no doubt will end up on the street, thus able to have their way with honest citizens. Governor Newsom has said previously he supports the bill:

California lawmakers passed a bill on Wednesday banning private prisons from operating in the state – a move which will likely also lead to the closure of four large immigration detention facilities that can hold up to a combined 18,000 people, according to The Guardian.

The move is a dramatic shift for California, which used to rely on private prisons to reduce overcrowding in state-run facilities.

Private prison companies used to view California as one of their fastest-growing markets. As recently as 2016, private prisons locked up approximately 7,000 Californians, about 5% of the state’s total prison population, according to the federal Bureau of Justice Statistics. But in recent years, thousands of inmates have been transferred from private prisons back into state-run facilities. As of June, private prisons held 2,222 of California’s total inmate population. –

There are currently four private prisons in California operated by the Geo Group, whose contracts expire in 2023 and cannot be renewed under the new legislation, unless ordered by a federal court in order to reduce overcrowding.

In addition to signaling a major criminal justice reform, AB32 also has become a flashpoint in California’s fight with the Trump administration over the treatment of immigrants.

The bill’s author, the assemblymember Rob Bonta, originally wrote it only to apply to contracts between the state’s prison authority and private, for-profit prison companies. But in June, Bonta amended the bill to apply to the Immigration and Customs Enforcement agency’s four major California detention centers.

Bonta’s amendment, say immigrant rights advocates, appears to have caught Immigrations and Customs Enforcement (Ice) and the private prison companies at a moment when their current contracts are expiring. The result is that instead of slowly phasing out immigration detention centers as their existing contracts expire years down the road, most will face closure next year – unless Ice and its private prison contractors find a workaround. –The Guardian

Illegal Alien invites ICE to community meeting now faces deportation

Illegal invites ICE to a community meeting to address “community concerns over immigration.” Let’s see what could go wrong.

He had pled guilty to a burglary charge earlier, was shipped back to Guatemala and decided to wander back over the border to the USA illegally a couple of months later because there was no one big beautiful wall. Now he awaits deportation

Today’s feel good story of the day.

The Daily Dot reported:

A Guatemalan father of five and revered member of his community has been detained by Immigration and Customs Enforcement (ICE) within weeks after he invited ICE members, among others, to a community meeting organized to address people’s rising concerns about immigration, according to reports.

Roland Gramajo, 40, organized a community meeting in southwest Houston, Texas, in August, as President Donald Trump’s orders for ICE raids riled up communities across the country, the Houston Chronicle reported.

On Thursday, he was arrested near his home and is facing deportation, the New York Times reported. It’s unclear if ICE members accepted the invitation and officially attended the community meeting. Some attendees reported that they’d seen some men, seemingly out of place, take photos of Gramajo, which some now believe were ICE agents “secretly” attending the meeting, the Times reported.

Gramajo first came to the U.S. in 1994 and outstayed his tourist visa. In 1998, he pled guilty to burglary charges. His daughter says it was a practical joke with a friend, who eventually wanted to drop the charges, that spun out of control. The case went ahead anyway, and he was deported in 2004.

He crossed back months later, without documents, and has since lived in the country.

Other than that all is well in the swamp.

A citizen’s militia group, 300 illegals and a citizen’s arrest

Citizen’s Arrest

  by Mustang

Very recently, a citizen’s militia group arrested 300 illegal aliens in the state of New Mexico.  The leader of this group has been arrested and charged as a felon in possession of firearms.  The felony, according to the news, was that he made threats on the lives of a former president and secretary of state.  Whether this is true goes far beyond my interest in the incident, except that it was stated that these militia members could be charged with kidnapping (the illegals).  Note: New Mexico attitudes would be better understood by simple removing the word “New” in its title.  But there is a larger issue.  I’ll present it in steps.

Step 1: Title 8, United States Code 1325: Improper entry by an alien

Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or (2) eludes examination or inspection by immigration officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall … be fined under Title 18 or imprisoned not more than six months or both, and …

Step 2: United States Common Law

In the United States, a private person may arrest another without a warrant, for a crime occurring in their presence.  For which crimes this is permitted may vary from one state to another.

Step 3: New Mexico Law: Stat 31-4-14 (1937)

The arrest of a person may be lawfully made also by any peace officer or private person without a warrant upon reasonable information that the accused stands charged in the courts of a state with a crime punishable by death or imprisonment for a term exceeding one year, but when so arrested the accused must be taken before a judge or magistrate with all practicable speed and complaint must be made against him under oath setting forth the ground for the arrest … and therefore his answer shall be heard as if he had been arrested on a warrant.

Discussion

The simple part of this is that citizens of the United States armed themselves and went to a known illegal alien trafficking area.  While in this area, 300 illegals came upon these citizens and surrendered, requesting asylum.  The citizens held them (detained them) and called for immigration officers, who arrived and took said 300 asylum-seekers into custody.  By the wording of the federal statute, illegal entry appears to be a misdemeanor, not a felony, unless the perpetrator has unlawfully entered the United States on more than one occasions.  In my view, this is a serious fallacy of the federal law.  First time offense should be a felony and treated as such.

Since this incident, all the far-left whacko’s in Nuevo Mexico have experienced a pandemic of exploding heads.  The citizens are being described, among other things, as vigilantes and armed thugs.  The illegal aliens are being described as “asylum-seekers.”  In both examples, an appeal to emotion that defeats their position from its beginning.  But I do think that the matter should interest all of us.

If these citizens have taken it upon themselves to augment an overwhelmed border patrol, I should think that federal authorities would be grateful for their help.  Maybe the state and federal government should encourage American citizens to involve themselves.  For example, they could organize state and/or federal posse’s —the membership of which could be carefully regulated with mandatory training and certification.  They might also secure a waiver for liability should any of these citizens be killed while acting in such capacity (which is entirely possible along the US-Mexico border).

But were these illegal aliens kidnapped?  No.  They were detained.  Law enforcement was summoned to the scene immediately.  Were these citizens acting as vigilantes or thugs?  It doesn’t sound like it to me.  But here’s what didn’t happen: no shots were fired; no one was cuffed; no one was transferred to another place against their will.

What it does sound like is that the federal government, who by the mere size of the US-Mexico border region, is incapable of doing its job, but does not want the scrutiny of citizens who simply want to achieve safety in their own communities.  Rather than taking advantage of citizens willing to step forward (at no cost to either state or federal authorities), they are in the process of heaping charge after charge against them.

UPDATE:

United Constitutional Patriots New Mexico Border Ops more still flooding in

Video of what happened:  https://www.dailymail.co.uk/video/news/video-1907580/Video-armed-militia-catch-asylum-seekers-cross-border.html

Kidnapping is a serious offense.  I’m not seeing any element of kidnapping in this case, but since the authorities want to play hardball (to make an example of them) these fellows would be best advised to find a damn good lawyer.

Why this post?  I’m curious about the opinions of Bunkerville readers.

Illegal alien set free from Sanctuary City rapes child, previously deported

You have to look at illegal aliens through the eyes of the Democrats. What is the mental and physical well-being of a child, compared to gaining another Democrat voter?

The child is merely collateral damage as far as they are concerned. Juan Ramon-Vasquez was arrested in Philadelphia and refused to honor ICE’s detainer request. Ramon-Vasquez celebrated his release by repeatedly raping a young child over a period of time.

He has since been sentenced to 21 months for being in the country unlawfully and another 20 years for the child rape. Thank you liberals. This child would never have been raped without your invaluable help.

From the city of brotherly love… We knew it was going to go this way. Just one of many of similar stories that will not get the attention it deserves.

After being deported in 2009, Ramon-Vasquez was found to be living back in the country in March 2014 in Philadelphia. At the time, the illegal alien child rapist was in Philadelphia Prison Department custody, but the local authorities refused to turn Ramon-Vasquez over to the Immigration and Customs Enforcement (ICE) agents for deportation due to the city’s sanctuary city policy that shields criminal illegal aliens from arrest and deportation.

Democrats don’t want ICE notified when illegals try and buy a gun

Oh this should work out swell. Not enough that it’s open border time. Let’s be sure and give them a bonus card for being too stupid to try and sign up for a gun. By the way, I wonder just why our newly minted illegals would want a gun? Any ideas folks?

As the debate over illegal immigration continues to rage, Democrats continue to prove they are proponents of open borders and lawlessness.

The latest example comes from Republican Congressman Matt Gaetz, who is berating Democrats for protecting illegal aliens who attempt to purchase firearms and fail a background check.

From Gaetz Tweet:

Democrats in the Judiciary Committee just voted against notifying ICE when an illegal alien fails a background check to buy a gun. They hate ICE so much that they’d keep ICE in the dark when illegals try to get guns!

Town Hall

The FBI this year has barred a record number of cases of illegal immigrants from buying guns, according to a new report of background checks.

The National Instant Criminal Background Check System listed 7,836,600 “illegal/unlawful alien” as of 2018.

That number has been increasing in recent years.

Illegal immigrants rank at the top of those on the FBI’s “prohibited category.”

Saturday flashback – DHS buys 100,000 mens briefs up to size 6X

Let’s do a November 2014 Saturday flashback. Obama thought of everything when dealing with our fence jumpers from around the world. But he didn’t care so much for our Border Agents.

Obama shipped illegal gang banger kids from South of the border into our neighborhoods without so much as telling the Governors of the States involved.  At least we can feel great that when they strut their stuff with their pants hanging around the low-end of their butt, we will have paid for their underwear. Anyone want to bet they weren’t made in the good old USA? On second thought, just who are these size 6 Xers? The Obama Department of Homeland Security is purchasing 100,000 pairs of underwear and sports bras for illegal aliens.

ICE made a similar purchase only five months ago when the agency purchased 42,000 pairs of men’s underwear, including 6X-Large briefs for men weighing over 450 pounds.

“We have to accommodate all varieties of sizes since we encounter a global population,” ICE spokesman Carl Rusnok told the New York Post.

Here is the bid solicitation.  Meanwhile, are Border Agents being quietly unarmed? Obama will do everything and anything to demoralize those that would protect us. But plenty of money for underwear.

Your tax dollars, hard at work.

Border Patrol being stripped of their rifles

The News 4 Tucson Investigators have uncovered that some U.S. Border Patrol agents have lost a key part of their arsenal. And that has agents who patrol along the border here, extremely worried.

We learned that U.S. Customs and Border Protection’s Offices of Border Patrol and Training and Development are inspecting the quality of agents’ M4 carbines throughout Border Patrol sectors nationwide. But agents tell us, some of those M4s have not been replaced. And, we’ve learned, agents are required to share rifles amongst each other.

“There’s a lot of agents that are pretty upset over it,” said Art del Cueto, president of the Border Patrol’s Tucson Sector union. “We know it’s a dangerous job. We know what we signed on for but we want to have as much of the equipment as we need to perform the job.”

Obama separated 72,410 children from their illegal immigrant parents

Of course you will never see this in the MSM. Of course not. One can only wonder after this kerfuffle dies down, what more does the Left have at the ready to energize their base? It’s amazing isn’t it. Just as the IG report and hearings were happening, this just rose to the top of the food chain news by the media. In perfect lock step. I will add the legal justification, or lack thereof of AG Eric Holder on the taking of the Gonzalez child at gunpoint to return him to Cuba.

AG Holder doing a little deporting of a child

In 2013 Barack Obama separated 72,410 children from their illegal immigrant parents who were deported.

The Huffington Post reported:

Immigration and Customs Enforcement last year carried out more than 72,000 deportations of parents who said they had U.S.-born children, according to reports to Congress obtained Wednesday by The Huffington Post.

The reports were sent by ICE in April to the Senate Appropriations Committee and the Senate Judiciary Committee, as required by law. ICE confirmed the authenticity of the two reports, which lay out 72,410 removals of immigrants who said they had one or more U.S.-born children in 2013.

The reports show that even parents of U.S. citizens are among the hundreds of thousands of undocumented immigrants being expelled from the United States each year…

… When a parent is deported, their U.S.-born children sometimes leave with them. But some stay in the U.S. with another parent or family member. Some children end up in U.S. foster care. H/T: Gateway Pundit

I give you this flash back:

Eric Holder dispensed with Elian Gonzalez, not so much our new ‘refugees’

……Even as the mace dispersed and Elian’s legal custodians sought medical help for their injuries, Fox News’ Andrew Napolitano already had Eric Holder’s number:

“Tell me, Mr. Holder,” Napolitano asked on April 23, 2000, “why did you not get a court order authorizing you to go in and get the boy (Elian Gonzalez)?”

Holder: Because we didn’t need a court order. INS can do this on its own.

Napolitano: You know that a court order would have given you the cloak of respectability to seize the boy?

Holder: We didn’t need an order.

Napolitano: Then why did you ask the 11th Circuit Court of Appeals for such an order if you didn’t need one?

Holder: [Silence]

Napolitano: The fact is, for the first time in history you have taken a child from his residence at gunpoint to enforce your custody position, even though you did not have an order authorizing it. When is the last time a boy, a child, was taken at the point of a gun without an order of a judge? Unprecedented in American history.

Holder: He was not taken at the point of a gun.

Napolitano: We have a photograph showing he was taken at the point of a gun.

Holder: They were armed agents who went in there who acted very sensitively…

The nature of this “sensitivity” I’ve already mentioned, including the number injured by the mace, gun-butts, and jackboots. Thanks to the ritual MSM-Castroite collusion, most people forget (or missed) the crucial legal and ethical details of the Elian circus/tragedy — which were mostly established during the first week after the boy’s rescue at sea, after his mother’s drowning.

Over 800 churches harbor illegals in U.S.

I found this report interesting as I had attended the Arch Street United Methodist Church back in the early 1980’s which is discussed. I witnessed the church devolve into allowing the homeless to disrupt services, wandering about, talking out loud. It wasn’t even safe leaving one’s purse behind when going forward to take Communion. Needless to say I left the church as so many others as they become no more than political operations. It’s big money for religion in resettlement of the so called refugees. Check out

Church World Services breaks law, yet receives refugee resettlement funding

The nine major federal resettlement contractors determining the futures of your cities and states and which like to call themselves VOLAGs (short for Voluntary agencies)—a joke considering how much federal money they receive.

But let’s get back to the story:

A new report reveals how churches nationwide are harboring illegal immigrants, helping them evade federal immigration orders for deportation.

In a 60 Minutes special report, more than 800 churches are acting as mini-sanctuary jurisdictions to hide illegal immigrants from Immigration and Customs Enforcement (ICE) agents.

ICE has a long-standing policy in which agents do not detain illegal immigrants at churches, making the facilities an ideal spot to avoid deportation orders.

In a Buffalo, New York, church profiled, parish staff confirmed that they recently harbored an illegal alien family of four from Honduras. Since January, the church officials said it protected more than 40 migrants.

Rev. Robin Hynicka of Philadelphia’s Arch Street Methodist Church explained how he believes enforcing federal immigration laws are oppressive to illegal immigrants who remain in the U.S.

“It’s injustice and oppression, all of which is evil,” Hynicka said. “Yeah, when a human being’s human rights are denied, when they can’t stay with their family, when they can’t work, when they can’t participate in the community in which they have deep roots, all of those apply.”

In one specific case, Hynicka’s church has been harboring Javier Flores Garcia, an illegal immigrant from Mexico who came to the U.S. in 1997. Garcia was arrested and convicted for drunk driving, and despite an immigration judge ordering him be deported, he remains hiding out in Arch Street Methodist Church.

Border agents disarmed, but DHS has money for underwear

The Obama Department of Homeland Security is purchasing 100,000 pairs of underwear and sports bras for illegal aliens. Here is the bid solicitation:FBO Meanwhile, are Border Agents being quietly unarmed? Obama will do everything and anything to demoralize those that would protect us. But plenty of money for underwear.

“And, we’ve learned, agents are required to share rifles amongst each other.”

Infowars reported:

The Department of Homeland Security, which has been stripping Border Patrol agents of their rifles without replacement, is buying nearly 100,000 pairs of underwear, including sport bras, for illegals.

Immigrations and Customs Enforcement, a division of DHS, announced today it is seeking a company that can provide a wide variety of cotton briefs, panties, and sports bras in various sizes for boys, girls, and women.

“If your company can provide the product/services listed on the solicitation and comply with all of the solicitation instructions, please respond to this notice,” the announcement reads.

The sizes requested range from extra tiny to super large and the overall order is massive enough to accommodate nearly the entire population of Boulder, Colorado.

The request for boys’ underwear in particular alludes to the sudden surge of border crossings by gang members, which the Border Patrol said has increased by 100%.

ICE reveals list of convicted murderers it freed. In your town?

What with Ebola, the respiratory virus, and the release of convicted murderers in our midst, does anyone believe that Obama gives one whit about the safety and health of us? Every day, in every way, he shows his contempt for us. Here we go:

The 169 aliens with homicide-related convictions who were freed by ICE in 2013 were booked out of detention facilities in 24 different states, with the largest number in California, according to information provided to Sen. Chuck Grassley (R-Iowa). ICE records show that these convicted killers were associated with 96 different cities and towns across America. The city with the largest concentration was Miami, with seven convicted murderers freed by ICE, followed by Los Angeles with six.

Some of the court-ordered releases are the so-called Zadvydas cases, where ICE must release or anticipates being ordered to release an alien because the alien’s country refuses to cooperate in the deportation process. Others are likely the result of a Ninth Circuit ruling allowing for bond hearings for aliens whose detention lasts for six months.

ICE says that the discretionary releases were due to “eligibility for bond” or “deteriorated health or advanced age”, without providing details or numbers.

CE’s response follows on an internal audit report on ICE’s botched case management that resulted in the release of 2,226 detainees in February 2013. Most of those releases occurred in Texas and Arizona.
