Federal Judge blocks Trump’s new rules that hinders asylum

 

Meanwhile Congress sits on their hands and does nothing. The “caravan’ arrived about ten days too late. We needed this at the time of the election. Of course the media denied that this was even happening. Next hearing is December 19 which means by then they all should be in here. UPDATE:

The bottom line is that one cannot apply for asylum unless they come in legally.

How can they apply if they jump the fence since they will be illegals? I don’t have my legal degree, but that is how I read it. Why not clear it up?

A federal judge in San Francisco late Monday blocked new rules put into place by President Donald Trump that limit the ability of migrants to request asylum, a legal blow to the administration’s efforts to curb legal immigration that opens the door for more members of the migrant caravan to request asylum in the U.S.

U.S. District Judge Jon Tigar ruled that the administration’s new policy of cutting off asylum to migrants who enter the country illegally appears to run afoul of U.S. law that specifically allows them to do so.

The 1965 Immigration and Nationality Act states that any foreigner who arrives in the USA, “whether or not at a designated port of arrival,” may apply for asylum. But on Nov. 9, Trump tried to overrule that law, signing a presidential proclamation ending the ability of migrants to request asylum if they enter the country illegally. (So says USA Today.)

“The rule barring asylum for immigrants who enter the country outside a port of entry irreconcilably conflicts with the INA and the expressed intent of Congress,” wrote Tigar, who was appointed by former President Barack Obama. “Whatever the scope of the President’s authority, he may not rewrite the immigration laws to impose a condition that Congress has expressly forbidden.”

Tigar issued a temporary restraining order, meaning the administration is forbidden from enforcing the new rules until the court case proceeds on Dec. 19.

The number of asylum applications has skyrocketed in recent years, from 5,000 in 2008 to 97,000 in 2018, mostly fueled by Central Americans fleeing violence and poverty in their home countries. More at USA Today

Yo Mexico Caravan- The Yanks Are Coming

 

Trump said he wanted the “nuclear option” used to settle the issue regarding immigration reform.  The so-called Caravan heading toward our border, or rather parts of it, think that they have an entitlement to all of our goodies, and for now most will. So let’s send the Yanks. Bush did as well as Obama but you won’t read that in the media. So tell me.. why go to all the trouble of climbing any wall? Walking? Why not just walk in and not show up for your hearing to be held a couple of years later after you cross a border crossing and say you are in fear?

Trump threatens to send military forces to guard border – NY Daily News

A frustrated President Trump threatened Tuesday to send military forces to secure the nation’s southern border on as he fumed over the lack of progress on his cherished wall.

“We’re going to be doing things militarily,” Trump said during a White House lunch with Baltic leaders. He called the measure a “big step.”

The U.S. Border Patrol is currently tasked with protecting the boundary with Mexico.

Trump has railed in recent days against “weak” immigration laws in the U.S. — declaring protections for so-called Dreamer immigrants “dead,” accusing Democrats of allowing “open borders, drugs and crime” and warning Mexico to halt the passage of “caravans” of immigrants.

George Soros tells us how to rebuild the Asylum System

If we had any doubt as to who was behind the plan to swamp the Western world with third world “refugees”, you can doubt no more. This from the “horses mouth” Soros himself. I caught the take on it from George Soros and the Muslim invasion of Europe a post from American Thinker… then I went to Soros himself.

Soros has plans — BIG plans — for Europe to “put an end to the panic and the unnecessary human suffering.” For Muslims. Europeans will suffer plenty.

NEW YORK – The European Union needs to accept responsibility for the lack of a common asylum policy, which has transformed this year’s growing influx of refugees from a manageable problem into yet another political crisis. Each member state has selfishly focused on its own interests, often acting against the interests of others. This precipitated panic among asylum seekers, the general public, and the authorities responsible for law and order. Asylum seekers have been the main victims.

Here are the six components of a comprehensive plan.

First, the EU has to accept at least a million asylum-seekers annually for the foreseeable future. And, to do that, it must share the burden fairly – a principle that a qualified majority finally established at last Wednesday’s summit.

Adequate financing is critical. The EU should provide €15,000 ($16,800) per asylum-seeker for each of the first two years to help cover housing, health care, and education costs – and to make accepting refugees more appealing to member states.

Second, the EU must lead the global effort to provide adequate funding to Lebanon, Jordan, and Turkey to support the four million refugees currently living in those countries.

Third, the EU must immediately start building a single EU Asylum and Migration Agency and eventually a single EU Border Guard. The current patchwork of 28 separate asylum systems does not work: it is expensive, inefficient, and produces wildly inconsistent results in determining who qualifies for asylum.

Fourth, safe channels must be established for asylum-seekers, starting with getting them from Greece and Italy to their destination countries. This is very urgent in order to calm the panic. The next logical step is to extend safe avenues to the frontline region, thereby reducing the number of migrants who make the dangerous Mediterranean crossing.

The operational and financial arrangements developed by the EU should be used to establish global standards for the treatment of asylum-seekers and migrants. This is the fifth piece of the comprehensive plan.

Finally, to absorb and integrate more than a million asylum seekers and migrants a year, the EU needs to mobilize the private sector – NGOs, church groups, and businesses – to act as sponsors. This will require not only sufficient funding, but also the human and IT capacity to match migrants and sponsors.

Sunday Respite: Cuban Music for our newest ‘refugees’

Here they come. Open the gates. Tens of thousands of Cuban ‘refugees.’ This should change Florida and Texas voting patterns big time. Just watch them hop on the next available plane or boat. All are eligible for ‘refugee’ status.

Cuban Refugee Adjustment Act

The Cuban Refugee Adjustment Act, as the name suggests, helps make it easier for Cuban citizens to escape Cuba and get permanent residence in the United States. Any Cuban citizen who has been inspected, admitted or paroled into the United States can apply for a Green Card after living in the United States for one year. The spouse and young children of Cuban citizens can use this law to get a Green Card, even if they are not Cuban citizens themselves. Someone who was born in Cuba but becomes a citizen elsewhere can get a Green Card under this law.

Furthermore, a Cuban who has had a family based petition approved can be paroled into the United States while he or she is waiting for a Green Card. The United States government also runs a lottery that allows Cuban citizens to migrate to the U.S.

Asylum

If a Cuban citizen cannot manage to take advantage of the Cuban Refugee Adjustment Act, he or she can still apply for asylum. There are many human rights abuses in Cuba that would make people afraid to return to or remain in Cuba.
The U.S. State Department lists the principal human rights abuses in Cuba as “abridgement of the right of citizens to change their government; government threats, intimidation, mobs, harassment, and detentions to prevent citizens from assembling peacefully.”

According to reports, it was common for government officials to detain people for political reasons, and prisoners were often harassed and tortured. Free speech is only allowed to the extent that is supports the government and socialism; anyone who speaks out against either can be sent to jail. If people assemble to protest, the government typically organizes mobs to attach protestors. While the Cuban president’s daughter, Mariela Castro, has spoken out in favor of the rights of lesbian, gay, bisexual, and transgender (LGBT) people, activists report that discrimination against LGBT people is common.

Asylum audit finds fraud, laws broken. More to come in by thousands

Yesterday I posted Obama to give those with ‘tangential’ terrorist connections asylum, refugee status. Fox news had a report on the status of this Executive order, and it is even worse than reported. First of all it is illegal for Obama to order this. Obama has the right to change asylum on an individual basis, but not wholesale. Also the most underreported story is that this very asylum business is what brought the terrorists to Boston do their nasty bombing during the marathon. Now today, this headline.

The Washington Times reports: Audit finds asylum system rife with fraud; approval laws broken with surge of immigrants

At least 70 percent of asylum applications showed signs of fraud, according to a secret 2009 internal government audit that found many of those cases had been approved anyway.
The 2009 fraud assessment, obtained by the House Judiciary Committee and reviewed by The Washington Times, suggests a system open to abuse and exploitation at a time when the number of people applying for asylum in the U.S. has skyrocketed, particularly along the southwestern border.
Another report obtained by the committee suggests that the government isn’t detaining most of those who apply for asylum, including those awaiting a final judgment.
Judiciary Committee Chairman Bob Goodlatte said the documents taint the credibility of the asylum system, which is designed to provide an outlet for foreigners who face real risks of being harmed if they remain in their home countries.

“Asylum fraud undermines the integrity of our immigration system and hurts U.S. taxpayers. Once individuals are granted asylum, they receive immediate access to all major federal welfare programs. Our immigration system should be generous to those persecuted around the globe, but we must also ensure our compassion isn’t being abused by those seeking to game the system,” Mr. Goodlatte, a Virginia Republican, said in a statement to The Times.

Obama to give those with ‘tangential’ terrorist connections asylum, refugee status

This sure gives new meaning to “come on over.” As if we are not already inundated with potential terrorists gliding over our borders unimpeded. Lets  bring them in from especially Syria, the new breeding ground for Al Qaeda and any other Muslim group that hates America. No question but Obama is doing everything in his power to destroy what is left of the America we knew. Why on earth would we take a chance on this ignorant behavior. Already we have millions unemployed, and these new arrivals? I am sure they will have fine employment skills.

The Obama administration is quietly making it easier for people with tangential connections to terror groups to receive refugee status or asylum in the United States.

Two new exemptions to the Immigration and Nationality Act published in the Federal Register Wednesday by the Departments of Homeland Security and State mean that who provided “insignificant” or “limited” material support for terror groups will no longer be automatically denied eligibility from asylum or refugee status.

The rules will affect about 3,000 people who have pending asylum cases, one refugee advocate said, and an unknown additional number of people currently in the process of being deported. It will likely help Syrian refugees who would otherwise be blocked from receiving U.S. aid by existing rules.
