Impeachment Hearing witness Noah Feldman Guilty of Perjury


This is supposedly one of the best and brightest attorneys who was to lay waste to Trump. Instead there should be a criminal referral. Feldman was at this since 2017 if not before. Even more disturbing is his opinion that a President does not have to commit a crime to be impeached.

Because Feldman is a Democrat nothing will happen to him for lying under oath. Full stop

What the president did is an outrage. It’s impeachable, and obstruction of justice in the sense of being a “high crime and misdemeanor.” But it’s almost certainly not a crime of obstruction of justice.

So the distinction you’re making is between what would be a crime for you or me to commit versus a guy who lives in the White House?
Exactly. The word “high”—people have just lost track of this—in “high crimes and misdemeanors” does all the work. It does not mean ordinary statutory violations. It mean acts by the president in the exercise of his office that abuse power, are corrupt, or undermine the rule of law. That’s the essence of what high crimes and misdemeanors have always been—they meant that before the founding, they’ve meant that ever since. You can impeach someone who hasn’t committed any demonstrable federal crime, or state crime for that matter.

So just to clarify, this looks like obstruction of justice in the high crimes and misdemeanors sense but not in the Jeff Sessions–led Justice Department will do anything about it sense?
Correct. And frankly, breaking the norm of politicizing law enforcement—it’s a great basis for impeachment. It’s not a crime, and in fact it’s in the president’s constitutional authority, but it’s still impeachable. That’s the whole point—the president can do things within his legal constitutional authority where the only sanction available under our system is impeachment.

    The more this goes on the more obvious it is that this is just a scam and the Dems are going to impeach him although he did nothing wrong. We can only hope at this time that this whole fiasco backfires on them but most of the people on the left are all in on this. I have a couple of liberal friends on Facebook and they have bought into this hook, line, and sinker. Hopefully they are the outliers when the election rolls around.

      As long as the senate can get along and agree on the witnesses.. That I am not so sure about.. discord in the senate will be the issue thus demotivating gop voters in the election.

    All of this crap is causing me to have (minor) anxiety attacks. Now I know that Trump will prevail, but the anger that is building in me is making it very, very hard to not hate the people causing this nonsense.

If I had more confidence in the GOP Senate I would not be as concerned. comment to cheryl…We have much to worry when it goes to the senate… I understand the senate votes on who testifies…. count the numbers……Sasse,Romney,Collins, now that new guy that just got in to fill in…LA or Mississippi.. we may not have the votes to go after the big guns.
      A comment made by the Senator who just resigned… can’t think of his name…. its all about the Senate and the Dems want it. This will divided the Senate.. They are so far ahead of us…

        I don’t want to blow my own horn but I have been saying for months now there is a better chance than not that the senate turns blue in the next election. The electorate, the double standard in the law and the lemmings in the GOP: The perfect storm…. and how long before we have a living breathing Constitution? It’s over.

    Have you read the irony of it all in reference to Jonathan Turley’s testimony from yesterday’s hearings

    Mr Turley, who by the way stated he was no Trump fan, is now receiving threats to his place of work and at home

    All one can really ask is and by no means to be disrespectful

    But…

    Mr Turley how does it feel?

    I only wish this was a clown show and a circus. We could all just walk out and get refunds on our tickets. Most of the guys I know can’t even stand to watch it, but get enough info to make them outraged. This truly is a constitutional crisis. Beyond belief this is happening and these crooks in Congress and the intel agencies aren’t up on treason charges. Un-freaking real.

        The arguments are so insane it’s impossible to believe this is happening, Bunker. Colliers said it yesterday when he asked the so-called experts if they had personal knowledge of any of the facts and none of them held their hand up. Suddenly I am reminded of Lord of the Flies. We have much to worry about…..

    The prospect of this crone on the SCOTUS should be enough for any thinking, that’s the operative word here, voter not to vote for the Democrats candidate in 2020. Given the lack of intelligence and sophistication, education, working knowledge of history and critical thinking among the great unwashed there is a very good chance she will end up there. C’est domage, que lastima and in good old fashion English, what a pity.

    I would think he just argued against himself.
    That a High Crime should rise to a higher level than a “lower crime”.
    That there must be a higher bar to impeachment.
    What do I know?
    I’m not a lawyer.
