For any GOP Senator who cannot get their act together and support Trump’s Executive Order regarding funding the border, take a look at what the 9th circuit did last week. We have Open Borders now. And it is here. Well worth the full read guys in case you missed what happened.


Congress could never get away with creating constitutional rights for illegal aliens to remain here, yet a single lower court just did so on Thursday. And where Congress would face deep reprisal in the next election, faceless judges will never feel the heat.

Conservatives fear that extreme Democrats might actually abolish ICE and all immigration enforcement, but the lower courts are already systematically abolishing ICE’s authority, nullifying immigration enforcement statutes, violating separation of powers, and constantly increasing the wave of bogus asylum-seekers that they originally spawned with other radical rulings.

The latest ruling from the Ninth Circuit demonstrates that unless Republicans and the president begin pushing back against these radical judges and delegitimizing their rulings, Democrats will get everything they want without ever facing electoral backlash or even the need to win elections.

It’s truly hard to overstate the outrageously harmful effects of Thursday’s Ninth Circuit ruling. For the first time in our history, the courts have fabricated a constitutional right for those denied asylum to appeal to federal courts for any reason.

Here’s the background.

Hundreds of thousands of migrants are flooding our border, claiming the formula of “credible fear” of persecution. They get to stay indefinitely while they ignore their court dates in immigration court. Because of an amalgamation of several prior activist court rulings, mainly by this very circuit, roughly 90 percent of credible fear claims are approved by asylum officers and the claimants shielded from deportation, even though asylum status is ultimately rejected almost every time by an immigration judge.

Unfortunately, by that point it’s too late for the American people, who are stuck with the vast majority of these claimants remaining indefinitely in the country.

Yet rather than ending this sham incentive, the Ninth Circuit drove a truck through immigration law by asserting that there is now a constitutional right for even the few who are denied initial credible fear status and are placed in deportation proceedings to appeal their denials, not just to an administrative immigration judge but to a federal Article III judge for any reason.     Trump has done a good job at remaking the lower courts but it sure looks like it is not happening fast enough!

    I could not in good conscience impugn the integrity of any of these sitting jurists, but it is clear that the make-up of the Ninth USs Circuit Court is overwhelmingly liberal. There are good reasons for liberal judgments, of course; I’m just not smart enough to know what they are. But these 9th Circuit judges all come from the left coast, and they vote in accordance with their values, which for the most part are anti-American values.

    The US Ninth Circuit Court is the largest in the nation; there are 29 sitting appellate judges. Of these, 14 were appointed by Clinton; 11 by Carter/Obama … it is clearly a leftist court, beholden to the leftist philosophy that appointed them, and confirmed them. I am not surprised that the US Supreme Court has overturned 68% of this court’s decisions—which makes one wonder if any of these judges graduated from accredited law schools.

    I’m not sure the “leftist” point of view would change simply by changing the way we appoint federal judges. If elected by national legislatures or by popular vote, political biases would still govern the complexion of the court. Our system of judicial appointment is corrupt—just not sure what can be done about it. Some recommend that the Ninth Circuit be split into two sections. Would that help if any of the areas under its jurisdiction remained on the left coast? Probably not. My guess is that if we wanted to fix the federal court, the American people would stop electing Democrats to the presidency.

      It really doesn’t matter now Mustang… with the vote today against Trump just now, the Congress is perfectly winning to have us go extinct… I’ll raise a glass , and pick out another Blues number for my Sunday Respite… thats about all that I can do these days…

    So since the judges are appointed by the president, can the president censure them? BTW this is definitely related to the citizenship question for the 2020 census as well as the probable redistricting that will come as a result of discovering HOW MANY CITIZENS exist vs. voters….

      I understand its up to Roberts….. but then he has done nothing with the illegal FISA judges// I could be wrong..

      I think only the Senate can censure; the House can impeach, and the Senate can convict for removal … which makes a presidential nomination a very momentus action.

        I heard it reported that the FISA courts judges are under Roberts and its up to him regarding any investigation…..I must have been mistaken what I heard on the other judges, I take it you are right …. looks like going nowhere, nada

        You could be right about the FISA courts, Bunks … and if those courts aren’t un-Constitutional, then I don’t understand the concept. We didn’t need FISA courts during World War II … so why now, during the so-called war on terror? A power grab pure and simple, IMO. Was there anything at all the American people could do about it? No. And if what you say is true, then Justice Roberts acted “unconstitutionally” by supporting the FISA courts and stood by doing nothing when the Obama Horde abused the courts for political purposes.
