Federal Judge blocks Trump’s new rules that hinders asylum


Meanwhile Congress sits on their hands and does nothing. The “caravan’ arrived about ten days too late. We needed this at the time of the election. Of course the media denied that this was even happening. Next hearing is December 19 which means by then they all should be in here. UPDATE:

The bottom line is that one cannot apply for asylum unless they come in legally.

How can they apply if they jump the fence since they will be illegals? I don’t have my legal degree, but that is how I read it. Why not clear it up?

Don’t let the door hit you in the back side Paul Ryan for not supporting Trump and his wall. All we need is a simple bill today. Entrance for asylum has to be at a port of entry. But no. We will never get it. The Rinos want cheap labor.

A federal judge in San Francisco late Monday blocked new rules put into place by President Donald Trump that limit the ability of migrants to request asylum, a legal blow to the administration’s efforts to curb legal immigration that opens the door for more members of the migrant caravan to request asylum in the U.S.

U.S. District Judge Jon Tigar ruled that the administration’s new policy of cutting off asylum to migrants who enter the country illegally appears to run afoul of U.S. law that specifically allows them to do so.

The 1965 Immigration and Nationality Act states that any foreigner who arrives in the USA, “whether or not at a designated port of arrival,” may apply for asylum. But on Nov. 9, Trump tried to overrule that law, signing a presidential proclamation ending the ability of migrants to request asylum if they enter the country illegally. (So says USA Today.)

“The rule barring asylum for immigrants who enter the country outside a port of entry irreconcilably conflicts with the INA and the expressed intent of Congress,” wrote Tigar, who was appointed by former President Barack Obama. “Whatever the scope of the President’s authority, he may not rewrite the immigration laws to impose a condition that Congress has expressly forbidden.”

Tigar issued a temporary restraining order, meaning the administration is forbidden from enforcing the new rules until the court case proceeds on Dec. 19.

The number of asylum applications has skyrocketed in recent years, from 5,000 in 2008 to 97,000 in 2018, mostly fueled by Central Americans fleeing violence and poverty in their home countries. More at USA Today

    These judges are simply not going to allow Donald Trump to get anything accomplished and on this issue the Republicans are for amnesty so nothing is going to happen there.

    One judge says Trump can’t override immigration law.
    Another says Trump can’t undo Obama’s override of immigration law (DACA).
    Which is it to be?

    Well, Trump should ignore this judge. The presidential powers over immigration are clear. Over National Security which is is even More Clear.
    Our folks on the border should deny everyone asylum until this matter is resolved.

    What is the judge going to do? He can’t take action against a president. If they could, the judges could make any president they wanted to completely impotent !

    Ignore this judge.

    Politicization of our critical institutions will ultimately destroy us, and yet, I don’t know how human beings can set aside their political passions when they arrive at those lofty positions through political appointment. I think that what makes this situation even worse is that our politics has become so negative and nasty, common decency and common sense is defeated by it. We are on the path of the Roman Empire 2,000 years ago. We’d better wise up, but I don’t think we have it in us …

    I saw this news in the mid of the night on FOX and changed my post from another one to this subject….it’s so upsetting to think a president can say “You can only come in legally” and have an American judge overturn THAT?
    And it’s now going to the most liberal court in the land, the 9th Circuit, where they’ll deliver the same message but with mockery. Then the Supreme Court. Hopefully, soon.
    What a message this sends to people hoping to destroy our country “COME ON IN!! Our president can say ALL he wants but he’s always wrong, you’re coming, just wait a while!”
    Yes, one of the reasons the judge gave was how long these people have to wait.
    Until WE START PUTTING AMERICANS OVER THE DISCOMFORT OF IMMIGRANTS, WE ARE DONE. Does that sound heartless? Maybe. But this is now a crisis and we don’t deserve this.

    Yeah, he’s an Obama boy.

    Trump must stand his ground and if Kirstjen Nielsen, his Homeland Security Secretary has a problem with it, then the cream puff should resign or be terminated. I’m sick of these judicial activists getting in the way.
