Democrats have different slant on Supreme replacement now that they are in the minority


I picked up a couple of examples of the hypocrisy of the Democrats and Obama in particular regarding the possible lame duck appointment of a Supreme Court nominee. Just in case anyone asks, because the Media will not point out these discrepancies. Schumer and Obama were out there spouting their righteous indignation that they might not get their pick this year, but this is what they had done previously. FLASHBACK: In 2007, Schumer Called For Blocking All Bush Supreme Court Nominations

When George W. Bush was still president, Schumer advocated almost the exact same approach McConnell is planning to pursue. During a speech at a convention of the American Constitution Society in July 2007, Schumer said if any new Supreme Court vacancies opened up, Democrats should not allow Bush the chance to fill it “except in extraordinary circumstances.”

“We should reverse the presumption of confirmation,” Schumer said, according to Politico. “The Supreme Court is dangerously out of balance. We cannot afford to see Justice Stevens replaced by another Roberts, or Justice Ginsburg by another Alito.” During the same speech, Schumer lamented that he hadn’t managed to block Bush’s prior Supreme Court nominations.

Notably, when he made his remarks in 2007, Bush had about seven more months remaining in his presidential term than Obama has remaining in his.

In January 2006, then-Sen. Obama joined 24 colleagues in a futile effort led by Sen. John Kerry, D-Mass., to filibuster the Supreme Court nomination of now-Justice Samuel Alito.

On January 29, 2006, Mr. Obama told George Stephanopulos on “This Week” that he would “be supporting the filibuster because I think Judge Alito, in fact, is somebody who is contrary to core American values, not just liberal values, you know. When you look at his decisions in particular during times of war, we need a court that is independent and is going to provide some check on the executive branch, and he has not shown himself willing to do that repeatedly.”

Dems in Senate passed a resolution in 1960 against election year Supreme Court appointments

Read it and weep, Democrats. The shoe is on the other foot. David Bernstein at the Washington Post’s Volokh Conspiracy blog:

 Thanks to a VC commenter, I discovered that in August 1960, the Democrat-controlled Senate passed a resolution, S.RES. 334, “Expressing the sense of the Senate that the president should not make recess appointments to the Supreme Court, except to prevent or end a breakdown in the administration of the Court’s business.”  Each of President Eisenhower’s SCOTUS appointments had initially been a recess appointment who was later confirmed by the Senate, and the Democrats were apparently concerned that Ike would try to fill any last-minute vacancy that might arise with a recess appointment.

    Doesn’t matter if a democrat also called for this before. What matters is that this blocking behavior is completely utterly despicable and should be stopped – regardless of who is doing it, GOP or democrat.

    This may seem strange as a tribute to Scalia, but waiting ’til tomorrow may not come.
    He said himself that he hopes his replacement doesn’t undo all he has accomplished.
    So hoping I’ll see this day and sing it on Jan. 20, 2017 when Obama leaves…not knowing what tomorrow brings I’ll hum along now.

        Two points: First as an ardent Trump supporter I am finally starting to wonder if indeed he is the Dem’s nigger in the woodpile.
        Second: isn’t it refreshing to hear Chaka’s is straining at the leash to fulfill his constitutional duties after spending the past seven years ignoring and skirting it? Surely the newborn and born-again socialists have miracle whip running down their leg while salivating at the prospect of a left leaning court more than happy to strip away what rights still remain in our soon to be tattered constitution.

        I too was on the Trumpo wagon until Saturday’s debate. In other words, his demeanor is starting to get old, or maybe I am seeing a lot more of him than most. Either way, his rumbles of a third party and his ego making faces are getting on my fifth nerve. So if not Trumpo, who?

        I have never seen an angrier, more insecure yet egomanical man in my life…I think when he said “Megyn Kelly bleeds from….I don’t know where” was when I knew I couldn’t take him anymore. And it’s only gone downhill. For a Wharton grad, it’s amazing that the only adjectives he knows are HUGE, DISASTER, THOUSANDS AND THOUSANDS…..
        I pity him but I pity America even more.

        As for the Dems and Scalia; rarely do we see QUITE such hypocrisy as that info spelled out in your post. Blech!..

        Ah yes, injury to the fifth nerve of the Brachial Plexus from pulling the election lever for RINO’s all these years. Causes pain and numbness in the forearm and fingers. I had it last year for about a year. Couldn’t slide my breach to load or uncap a soft drink. It also made dressing difficult. I wondered if when I went to a nursing home for help, would they according to protocol slide my breach for me. Thank goodness as the literature on the net said it finally improved and mostly went away. I can do again.
        Yeah part of trigeminal neuralgia and can cause distorted face. And maybe bad words. 🙂

    While the shoe may be on the other foot there is no more than a 50/50 chance that the republican majority senate will come togather and do the right thing. What a sad state of affairs when we on the right, guided by recent history, have such little faith in those we have elected to carry out the will of the people.
